PokeAlerter Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the PokeAlerter iOS application, Android application, PokeAlerter Discord restock-alert service, website at https://pokealerter.com, related backend/API services, and Premium membership features (together, the “Service”).

PokeAlerter is operated under the trading name PokeAlerter

By creating or using a PokeAlerter account, using the Service, purchasing or renewing Premium membership, or otherwise accessing Premium benefits, you agree to these Terms. Our Privacy Policy also applies to your use of the Service.

1. Eligibility and accounts

1.1 You must be legally capable of entering into these Terms and must satisfy the minimum age and account requirements imposed by Discord, Whop, Apple, Google and any applicable law.

1.2 PokeAlerter relies on a valid and active Discord account. You are responsible for maintaining access to the Discord account linked to PokeAlerter and for keeping that account in good standing.

1.3 If your Discord account is suspended, banned, disabled, deleted or otherwise becomes inaccessible, PokeAlerter may be unable to authenticate you, verify Premium status or deliver Premium restock-alert functionality. Account-access disputes relating to Discord itself must be raised with Discord support rather than PokeAlerter.

1.4 You are responsible for activity carried out through your PokeAlerter and linked Discord accounts and for taking reasonable steps to protect access to your device and accounts.

2. The PokeAlerter restock-alert service

2.1 PokeAlerter provides informational restock alerts through the PokeAlerter iOS and Android apps and through configured Discord channels. The Service may include channel selection, notification preferences, custom alert tones, recent-alert history, product links and related Premium features.

2.2 We endeavour to provide a high level of uptime, speed and effectiveness. The Service is nevertheless provided on a best-efforts basis and does not carry a guaranteed uptime, delivery-time or availability service level agreement unless we expressly agree otherwise in writing.

2.3 Restock alerts are informational only. We do not guarantee that an alert will be received at any particular time, that every relevant restock will be detected, that the information in an alert will always be complete or error-free, or that stock will still be available when you open an alert. Retailers may change availability, price, purchase limits or product information at any time.

2.4 PokeAlerter does not reserve stock, purchase products on your behalf or guarantee that you will successfully complete a purchase.

3. Maintenance, interruptions and external events

3.1 The Service may from time to time be disrupted, slowed, paused, restricted or temporarily stopped where reasonably necessary for maintenance, security work, infrastructure changes, software or hardware updates, bug fixes, latency improvements, capacity upgrades, emergency maintenance, compatibility work or other service improvements.

3.2 Where reasonably practicable, we will seek to minimise planned disruption. However, some maintenance or incident response may need to occur without advance notice.

3.3 PokeAlerter depends on third-party systems and infrastructure including, as applicable, Discord, Whop, Apple Push Notification service, Google/Firebase Cloud Messaging, app stores, hosting providers, internet and telecommunications networks, retailers and content-delivery providers. We are not responsible for delay, interruption or failure to the extent it is caused solely by an event outside our reasonable control and not by a failure on our part to exercise the care required by law.

3.4 Events outside our reasonable control may include third-party platform outages, internet or telecommunications failures, power failures, natural disasters or other “acts of God”, fire, flood, severe weather, war, terrorism, civil unrest, government action, public emergencies, industrial disputes, widespread cyber incidents not caused by our failure to take reasonable security precautions, or other comparable events.

3.5 Nothing in this section removes any statutory rights or remedies that cannot lawfully be excluded or restricted.

4. App testing, defects and compatibility with other software

4.1 We test and analyse the PokeAlerter iOS and Android applications for bugs, crashes, inefficiencies, compatibility problems, security issues and other defects. Despite that testing, software can contain defects and we do not promise that every issue will be identified or corrected immediately or within any particular period.

4.2 If you discover that PokeAlerter conflicts with, crashes, materially degrades, blocks access to or prevents normal operation of another application on your device, you should stop using the conflicting configuration and contact PokeAlerter support. You should not knowingly continue using PokeAlerter in a configuration where a known conflict could reasonably prevent access to an essential, safety-critical or otherwise important third-party application.

4.3 PokeAlerter is not designed for emergency, medical, safety-critical, life-support, financial-trading or other use where a notification delay, software defect or application failure could reasonably be expected to cause serious harm.

4.4 Subject to applicable law, you remain responsible for deciding whether PokeAlerter is compatible with the other software and services you choose to run on your device.

5. Device and operating-system requirements

5.1 PokeAlerter is designed to run only on supported versions of iOS and Android and on devices that meet the hardware, memory, storage, network and other technical requirements published in the relevant app-store listing, PokeAlerter website or support materials from time to time.

5.2 You are responsible for checking compatibility before installing, upgrading or downgrading your operating system or materially changing your device configuration.

5.3 We cannot guarantee that an older app version will continue to work after you upgrade or downgrade your operating system, or that a new app version will operate on hardware that does not meet its minimum requirements.

5.4 Apple, Google and other app-store or platform operators may independently restrict installation, updates or availability based on device model, operating-system version, region, hardware capability, account status or their own platform rules. Where a restriction is imposed independently by an app-store or platform operator, PokeAlerter does not control that restriction.

6. Discord and Premium role requirement

6.1 Premium features depend on the linked Discord account having the required “Premium member” role in the relevant PokeAlerter Discord server.

6.2 If that role is removed, expires or cannot be verified, Premium-only channels and notifications may be disabled or restricted until the role is restored and successfully verified.

6.3 Your access to the PokeAlerter Discord server is also subject to the rules published in the Rules channel within Discord. Those rules form part of the acceptable-use requirements for the Service.

7. Whop, payment processing and Premium provisioning

7.1 Premium membership is purchased and billed through Whop. Whop processes the payment transaction and the current PokeAlerter access flow relies on Whop and/or Whop-integrated automation to trigger or provision the required “Premium member” Discord role following successful payment.

7.2 Whop is a separate platform with its own terms, buyer terms, privacy policy, payment systems and support processes. Your use of Whop is subject to the terms displayed by Whop.

7.3 Payment-layer issues such as duplicate charges, unrecognised charges or payment-processing errors should be reported to Whop as well as to PokeAlerter where appropriate.

7.4 Delays or failures may occasionally arise because of Whop outages, payment-provider problems, API delays or role-provisioning automation outside PokeAlerter’s direct control. We are not liable for losses caused solely by such third-party failure to the extent the law allows, but this does not remove any responsibility that PokeAlerter has as the supplier of the Service under applicable consumer law.

8. Subscription, redemption, cancellation and refunds

8.1 Premium membership is a recurring subscription unless the Whop checkout expressly states otherwise. You are responsible for reviewing the billing period, renewal date and amount displayed in Whop and for cancelling before the next renewal if you do not wish to continue.

8.2 For PokeAlerter’s discretionary refund policy, the Premium service is treated as commenced and redeemed once Whop confirms successful payment and Premium access has been provisioned or made available to the linked account. After that point, we do not ordinarily provide discretionary or pro-rata refunds merely because you did not use the Service, changed your mind after any applicable cancellation right has expired or been validly lost, missed a restock, failed to keep notifications enabled, or were later suspended or terminated for your own breach.

8.3 The preceding no-refund policy does not override any cancellation, withdrawal, refund, chargeback or other consumer right that cannot lawfully be excluded. Where applicable law gives you a cooling-off or withdrawal period, that right continues unless and until it is validly lost or modified in accordance with the law. Where checkout lawfully obtains your express request or consent for immediate supply and any legally required acknowledgement concerning loss of cancellation rights, the consequences of that consent will apply as provided by law.

8.4 Cancellation of Premium stops future renewal in accordance with Whop’s cancellation process. Cancellation does not normally generate a pro-rata refund for the current billing period unless required by law or expressly approved by PokeAlerter.

8.5 If you believe a payment was taken in error, duplicated, unauthorised, or taken after a valid cancellation had already become effective, contact Whop and PokeAlerter support promptly.

9. Premium price changes

9.1 We may change the price of Premium membership for future billing periods where reasonably necessary, including to fund infrastructure, software development, support, security, capacity, service reliability, latency improvements, new features or other improvements to the Service.

9.2 Any price change will not retrospectively alter an amount already paid for a completed billing period. Where required, notice will be given through Whop, PokeAlerter or another appropriate channel before the changed price applies.

9.3 Subscribers should check their Whop subscription and billing information for the current Premium price, renewal date and any notified price increase. Whop’s displayed renewal amount and any notice requirements imposed by law or the Whop platform will apply.

9.4 If you do not agree to a price increase, you should cancel Premium through Whop before the renewal at the increased price. Where applicable law or Whop requires additional consent before a price increase can apply, that requirement will be respected.

10. Premium access as a conditional membership benefit

10.1 Premium membership gives you a conditional, personal, revocable right to access Premium benefits during a valid paid subscription. It does not give you ownership of PokeAlerter, the Discord server, software, channels, infrastructure or intellectual property.

10.2 We may suspend or revoke Premium access and/or remove a user from the PokeAlerter Discord server where the user materially breaches these Terms, materially breaches the Discord Rules, uses the Service fraudulently or abusively, attempts to compromise the Service, harasses or threatens others, unlawfully redistributes Premium content or access, or uses the Service in connection with conduct that breaches applicable law.

10.3 Where access is terminated because of your material breach, no voluntary pro-rata refund will ordinarily be due for the remainder of the current billing period, subject always to rights that cannot lawfully be excluded.

10.4 If Premium access is revoked, you must promptly cancel any future recurring payment instruction in your Whop account if it has not already been cancelled. We will use reasonable efforts to terminate or disable the associated recurring membership through the tools available to us. You should verify the cancellation in Whop.

10.5 A payment taken after a valid cancellation or termination because of a duplicate charge, processing error or other payment-layer fault will be handled in accordance with applicable law and Whop/payment-provider rules. Such a payment is not automatically converted into non-refundable “credit”.

11. Acceptable use

11.1 You must not:

  • share, resell, sublicense or commercially redistribute Premium access unless PokeAlerter expressly authorises it;
  • attempt to bypass Premium-role checks, authentication, rate limits or access controls;
  • scrape, reverse engineer, probe, attack, overload or interfere with the Service except to the extent a legal right expressly permits an activity that cannot be restricted by contract;
  • use another person’s account or device token without authorisation;
  • misuse restock alerts, support channels or Discord facilities to harass, deceive or harm others;
  • use the Service for unlawful activity; or
  • breach the PokeAlerter Discord Rules.

11.2 We may investigate suspected abuse and take proportionate steps including warning, restriction, suspension or termination.

11.3 Communications by members, moderators and other community participants. Any communication made within PokeAlerter Discord channels, through PokeAlerter-related community channels, or by any other means by Premium member subscribers, moderators, volunteer moderators, community members or similar persons does not, by itself, represent or constitute an official statement, opinion, representation, warranty, advice or commitment of PokeAlerter. A communication will be treated as an official PokeAlerter communication only where it is expressly identified as such and is made by a person authorised to communicate on behalf of PokeAlerter.

11.4 Independent verification. You are responsible for exercising your own judgement and carrying out your own research and independent verification before taking, or deciding not to take, any action based on communications made within Discord or through any other community or support channel. This includes, without limitation, communications concerning stock availability, product information, prices, retailers, purchasing decisions, technical matters or the operation of the Service.

11.5 Human error and miscommunication. Communications made by individuals may contain typographical errors, omissions, misunderstandings, outdated information, incorrect wording or other forms of human error or miscommunication. To the extent permitted by applicable law, PokeAlerter will not be responsible for loss or damage caused solely by reliance on an informal communication of this kind where that communication was not an official representation or commitment for which PokeAlerter is legally responsible. Nothing in this clause excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

12. Intellectual property and app licence

12.1 PokeAlerter and its licensors retain all rights in the software, branding, interface, documentation, service logic and other original materials supplied by PokeAlerter, except for third-party material that belongs to its respective owner.

12.2 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the PokeAlerter app for your own lawful use during the period in which you are entitled to access it.

12.3 Product names, images, retailer information, Discord content and third-party trademarks may belong to their respective owners and are not transferred to you or PokeAlerter by inclusion in an alert.

13. Third-party retailers and links

13.1 Alerts may contain links to retailers or other third-party websites. PokeAlerter is not the seller of products offered by those retailers and is not a party to the purchase contract you enter into with a retailer.

13.2 We are not responsible for a retailer’s stock level, product description, price, delivery, cancellation, refund policy, queue, website performance, account restrictions or purchase decision.

14. No uptime or purchase-success guarantee

14.1 Although we aim for reliable and timely operation, no representation or warranty is made that PokeAlerter will operate uninterrupted, that notifications will always be delivered instantaneously, or that every alert will lead to an opportunity to purchase.

14.2 Nothing in these Terms excludes PokeAlerter’s obligation to perform the Service with the level of care and skill required by applicable consumer law.

15. Limitation of liability

15.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer right or remedy that cannot lawfully be excluded or restricted.

15.2 Subject to clause 15.1, PokeAlerter will not be responsible for losses that were not reasonably foreseeable when the contract was formed, losses not caused by a breach by PokeAlerter, or losses caused solely by a third party or event outside our reasonable control.

15.3 Subject to clause 15.1 and to the extent permitted by law, PokeAlerter is not responsible for the value of a product you were unable to purchase, speculative resale profit, loss of a purchasing opportunity, retailer price changes, retailer stock changes, or indirect or consequential loss arising merely because an alert was delayed, missed or unavailable.

15.4 For categories of direct financial loss that may lawfully be limited, and only where doing so does not reduce any non-excludable statutory remedy, PokeAlerter’s aggregate liability arising from the same event or series of connected events will not exceed the lower of (a) the single monthly Premium membership fee actually paid by you for the billing period giving rise to the claim, or (b) US$4.99.

15.5 The limitation in clause 15.4 does not apply where applicable law prohibits such a cap or requires a greater remedy.

16. Indemnification

16.1 To the extent permitted by applicable law, you agree to indemnify and hold PokeAlerter harmless from third-party claims, liabilities, losses and reasonable costs arising directly from your fraudulent or unlawful use of the Service, your wilful misconduct, your unauthorised redistribution or resale of Premium access, or your material breach of these Terms or the PokeAlerter Discord Rules, but only to the extent that the claim or loss was caused by your conduct and not by PokeAlerter’s own breach, negligence or other responsibility that cannot lawfully be excluded.

17. Support and complaints

17.1 For billing, technical, account, notification or other support, please contact PokeAlerter in the first instance through:

  • https://pokealerter.com; or
  • the designated support channel in the PokeAlerter Discord server.

17.2 Communications sent through other channels may not be monitored and we do not guarantee any particular response time for communications sent outside our designated support routes.

17.3 For payment-layer issues handled by Whop, you may also need to contact Whop support directly.

18. Disputes, arbitration and governing law

18.1 These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.

18.2 Before starting formal proceedings, you and PokeAlerter agree to make a reasonable attempt to resolve the dispute through the support process in clause 17. A party should provide a concise description of the dispute and the remedy sought and allow a reasonable opportunity for response.

18.3 Arbitration. Where both parties validly agree to arbitration after a dispute has arisen, the dispute may be referred to a single arbitrator under the Arbitration Act 1996. Unless otherwise agreed, the seat of that arbitration will be Manchester, England, reflecting PokeAlerter’s intended Northern England dispute venue, and the language will be English.

18.4 If you are acting as a consumer, nothing in these Terms requires you to submit a dispute to arbitration where a mandatory pre-dispute arbitration requirement would be unfair, unenforceable or otherwise restricted by applicable consumer law. Nothing prevents either party from using a court, statutory dispute procedure, regulator or other remedy that the law does not allow these Terms to exclude.

18.5 Subject to clause 18.4 and any mandatory jurisdiction rules that protect consumers, the courts of England and Wales shall have jurisdiction. Where procedurally available and appropriate, PokeAlerter may request that proceedings connected with the Service be heard in a court located in Northern England.

18.6 If you are a consumer resident outside England and Wales, you may also have mandatory rights under the law of your country of residence that these Terms cannot remove.

19. Changes to the Service and these Terms

19.1 We may make reasonable changes to the Service or these Terms for legal, regulatory, security, technical, operational, pricing or product-development reasons.

19.2 Where a change materially affects an ongoing paid subscription, we will provide such notice as is required by law and, where appropriate, allow you to cancel before the change takes effect for a future billing period.

19.3 Continuing to use the Service after an effective change means you accept the revised Terms to the extent permitted by law. A change will not retrospectively remove rights that accrued before it took effect.

20. Termination by you

20.1 You may stop using PokeAlerter at any time. To stop future Premium charges, you must cancel the recurring subscription using Whop’s cancellation mechanism before the next renewal date.

20.2 Deleting the PokeAlerter app does not necessarily cancel a Whop subscription.

20.3 Cancelling Premium does not by itself delete your Discord or Whop account. Data-deletion requests are handled separately in accordance with the PokeAlerter Privacy Policy.

21. Severability, waiver and entire agreement

21.1 If any provision of these Terms is found unlawful, unfair or unenforceable, that provision will be treated as modified or severed only to the minimum extent necessary, and the remainder of the Terms will continue to apply where legally possible.

21.2 A delay in enforcing a right does not waive that right.

21.3 These Terms, the PokeAlerter Privacy Policy, the applicable Premium offer shown at checkout, and the PokeAlerter Discord Rules constitute the principal terms governing the PokeAlerter Service. Third-party services such as Whop and Discord also impose their own separate terms on your use of those services.
